Please read these terms carefully as they set out the terms of use of I am KING. The use of our website includes accessing, browsing, registering, buying, and selling beats to the site, sending dance and music videos, and applying and registering for different affiliate programs. In case we change these terms we will notify you by mail if you are a member. Nonmembers should check our terms and condition from time to time.

About

-You are responsible for arranging your own access to the website

-You do not have to register to use this platform but certain Services are only available to registered users such as new updates, news, offers, and discounts.

-We will update our website from time to time but note that any of the content may be out of date and you should not rely on it. We do not guarantee that our site, or any content on it, will be free from errors or omissions.

-Music Producers and Artists who want to upload their Music to our site should send an email to georgefestus4001@gmail.com or contact +254745866548 and will receive instant feedback on the time and day the beat will be uploaded, the performance of their tracks, communicate with their listeners and manage their Content anytime.

Dancers who want to upload their videos or Content creators such as actors and vloggers should register as members and will receive feedback on the day the video will be uploaded. Kindly note, not all videos will be uploaded either because they have not followed our terms of use.

-When you register to use the Platform, you will provide us with your email address and name and we will send you a confirmation mail. Your email address and any other information you chose to provide about yourself will be treated in accordance with our Privacy Policy.

-Where our website contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources.

Sale

-The Price of the beat is determined by the Producer from a 10-70 $(dollars) limit and he/she is required to send the genre of the music.

-Beats below 25$ will incur a 15% service fee as we network your music.

-Beats above 25$ will incur 25 % of the amount sold as a service fee which will go to the development of the site and increasing platforms that will generate the development of music and artistic process’ in Africa such as adding diverse art galleries to the site.

-Members who have registered and have uploaded 3 beats will incur a 10% service fee instead and will be able to enjoy no service fee after being in our community for a period of six months. This is the Pro Package.

-Producers who invite 5 members to join will receive the Exclusive package that incurs only a 5% LIFETIME fee and sell any beat above 40$.

-We will update you on every sale you make and connect you with the one purchasing your music.

-Beats under a lease do not incur any cost whatsoever and details of the nonexclusive agreement should be indicated when sending the beat.

By accessing our website, you agree that you shall not breach another party’s intellectual property rights and that you will adhere to the terms of any license agreement.

Purchase

-All of our beats are paid from PayPal Account.

-The Lab requires all Producers to confirm that their Beats do not infringe any third party rights and that they have the necessary permissions to make the Beats available and grant ongoing rights to purchasers

-When you purchase Beats, it will be under the conditions and limitations of the license terms stipulated by the relevant Producer. These terms will be presented prior to completing the purchase of a Beat. If you do not agree to those license terms, you must not purchase that Beat. Any exploitation of Beats by a purchaser which is outside of the Producer’s license terms will be a potential breach of contract and a potential breach of intellectual property rights, for which you will be liable.

-As a purchaser, your contractual relationship relating to Beats is with the licensor or seller of Beats and not with My Pulse.

Usage of this Platform

IamFestus allows you to

Submit, upload, or post Content to and keep such Content available on the Platform strictly as permitted in accordance with these Terms of Use and any other applicable terms posted on the Website from time to time.
Participate in the community.
Buy and Sell beats at your price also according to the terms and conditions indicated in this document.
Download art and Pictures for free as we focus to embrace African art, Graffiti, and expose members to different and diverse forms of art around the world.
Post dance and music videos for free if you’re a dancer or any beautiful, educative content you have that embraces art and music.

The above policies are conditional upon your strict compliance with these Terms of Use and our Community Guidelines.

You must not use any Content (other than Your Content) in any way that is designed to create a separate content service or that replicates any part of the Platform offering.
You must not copy, attempt to copy, capture or attempt to capture any audio Content from the Platform or any part of the Platform, other than by means of download or store for offline listening in circumstances where the relevant Uploader has elected to permit downloads or offline listening of the relevant item of Content. If you print off, copy or download any part of our website in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
You must not collect or attempt to collect personal data or any other kind of information about other users, without limitation through spidering or any form of scraping.

You must not use the Platform to post upload, post, store, transmit, display, copy, distribute, promote, make available, continue to make available or communicate to the public:

Any content that is abusive, pornographic, that promotes or incites violence, terrorism, illegal acts, or hatred on the grounds of race, ethnicity, cultural identity, religious belief, disability, gender, identity, or sexual orientation.
Any Content that violates, breaches, or is contrary to any law, rule, regulation, court order, or is otherwise is illegal or unlawful in My Space reasonable opinion.

any information, Content or other material that violates, plagiarizes, misappropriates or infringes the rights of third parties including, without limitation, copyright, trademark rights, rights of privacy or publicity, confidential information or any other right; or
any material of any kind that contains any virus, worm, Trojan horse, spyware, adware, malware, bot, time bomb, worm, or another harmful or malicious component, which or might overburden, impair or disrupt the Platform or servers or networks forming part of, or connected to, the Platform, or which does or might restrict or inhibit any other user's use and enjoyment of the Platform.
Any unsolicited spam.

It is important that you protect your device from viruses and malware. We will not accept responsibility for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material on or downloaded from our website, or on any website linked to it.

You must not commit or engage in, or encourage, induce, promote any conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law or regulation.
You must not stalk, exploit, threaten, abuse, or otherwise harass another user, or any employee.

My Pulse is not responsible for any illegal, infringing, offensive Beats. Your beats will be uploaded for you by our team. Request to upload beats are sent to georgefestus4001@gmail.com. If you wish to notify us of any Infringing Material please email georgefestus4001@gmail.com. We are under no obligation to take any action, beyond what is required by any relevant laws or authorities.

You will not use the Beat Store or Marketplace for any illegal or offensive purposes.
You will comply with all laws and regulations relating to the sale of Beats.

Property Rights

We are the owner of the property rights in our website and materials published such as audio, text, videos, and any trademarks or brand rights and any other works which are protected by laws and treaties around the world. Our property rights are reserved.
Any content of desire to being uploaded to our website is generated, owned, and controlled solely by you, and not by IamFestus.
Your content is your sole responsibility

Payment and Pricing

Producers can set the sale price of Beats at between 10-50$, however, a service fee will be incurred not unless it is a LIFETIME subscription.

When Beats are purchased, the payment will be paid directly to a Producer’s nominated PayPal account within 4 working days. My Pulse will deduct a service fee automatically from the price of any purchases of Beat before any revenue is paid through the Producer.

Remain a registered user for a period of 1 year and incur no service fee.

Get updates on the latest offers, immediately and straight to your email address.
Uploading creative content that will benefit Art as a community and content that will follow our terms and policies.

Exclusive

Producers who invite 5 members to join will receive the Exclusive package that incurs only a 9% LIFETIME fee even for sell above 40$.

Invite 5 members to register and incur only a 9% service fee for a lifetime according to your price.
Producers are able to place an order for a Marketplace promotion through our website.

Your Beat will feature on the homepage at some point, however, the frequency will change depending on the number of other Beats featured during the same time period.

There may be instances where we are unable to accept your order because of technical issues or high demand. We will send an email confirming that we have rejected your order and refund any charges paid for the promotion.
